SteelSight Safety Disclaimer
Introduction
This Safety Disclaimer is a legally binding agreement between you and SteelSight Systems. By using the SteelSight application ("App"), you acknowledge and agree to the following.
SteelSight is an inspection-record and maintenance-documentation tool. It does not certify equipment, perform safety inspections, or determine fitness-for-service. This disclaimer explains the boundary between what the App does (capture and store records) and what only a certified inspector or qualified professional can do (judge equipment safety and authorize its use).
1. Reference and Documentation Tool Only
SteelSight provides:
- Inspection checklist templates derived from industry standards and manufacturer guidance
- A digital storage and synchronization layer for inspection records, maintenance logs, equipment records, photos, and audit logs
- Reports and exports built from the data your Company's users entered
SteelSight does not:
- Inspect equipment
- Verify the accuracy of any data a user entered
- Make pass/fail determinations on equipment fitness
- Authorize equipment for return to service
- Substitute for the judgment of a qualified, certified inspector
2. Inspection-Record Fidelity
An inspection record stored in the App reflects:
- What the inspecting user entered into the checklist
- When and where (if location was captured) the inspection was recorded
- Which photos the inspecting user attached
- The user account that submitted and certified the inspection
The App does not independently verify any of the above. A pass/fail entry indicates the inspector's stated conclusion, not an objective fact about the equipment.
If an inspection record is inaccurate — whether through honest error or deliberate falsification — the App will store the inaccurate record and synchronize it across devices exactly as it was entered.
Companies are responsible for ensuring that inspections are performed by qualified personnel and that records accurately reflect the inspection that was performed.
3. Checklist Templates — Reference Only
The inspection checklist templates included in the App are derived from industry standards (Alberta OHS Code, ASME B30 series, CSA Z150, CSA Z248) and manufacturer recommendations. These templates:
- Are starting points and should be reviewed against the specific equipment, manufacturer documentation, and jurisdiction-specific regulations
- May not be current with the most recent revision of an applicable standard
- Do not relieve the inspector or Company of the obligation to determine the appropriate inspection scope for a given piece of equipment
- Do not constitute legal, engineering, or regulatory advice
4. Photo Documentation Limitations
Photos attached to inspection records, maintenance logs, and equipment records:
- Document the equipment, defect, or condition at the moment the photo was taken — not ongoing or current condition
- May not capture all relevant detail; visual inspection at the equipment is the authoritative observation
- Are not tamper-detection records; while audit logs track when photos were added, the App does not forensically verify image origin
- Should be re-captured when conditions, repairs, or wear change
5. Regulatory Recognition of Digital Records
Whether a digital inspection record produced in SteelSight satisfies a specific regulatory documentation requirement depends on:
- The jurisdiction (federal, provincial, territorial, or international rules)
- The equipment class and applicable standard
- Whether your employer and the applicable regulator have agreed to accept digital records in lieu of paper
- Retention periods, signature requirements, and chain-of-custody expectations specific to the record type
Alberta Occupational Health and Safety Code requires minimum 3-year retention of inspection records and may require additional documentation for certain equipment classes. SteelSight retains records consistent with these obligations, but determining whether a SteelSight record satisfies any particular regulatory requirement is the responsibility of the Company and its safety leadership.
6. Audit Logs Are Not Tamper-Proof
The App records who took what action and when in an audit log. The audit log:
- Is designed to deter casual record manipulation
- Is replicated to the Company's server-side workspace, where it is protected by Row-Level Security
- Does not constitute a cryptographically-signed tamper-evident chain
- Should not be relied upon as the sole evidence of the integrity of a safety-critical record where regulatory requirements demand stronger guarantees
7. Equipment Status and Certification Tracking
The App allows users to record equipment certification dates, expiry dates, and status (e.g., active, out-of-service). These records:
- Reflect what users entered; the App does not verify certification documents
- Generate reminders based on the entered expiry date; missing or incorrect expiry data means missing or incorrect reminders
- Are not a substitute for the original signed certification document, which should be retained per applicable regulations
8. User Responsibility
By using the App, you acknowledge and agree that:
- You are solely responsible for the safety of any equipment you inspect, operate, or supervise
- You will not rely on the App as a substitute for certified inspector judgment, manufacturer documentation, or applicable regulations
- You will comply with all applicable safety regulations, including but not limited to: Alberta OHS Act and Code; ASME B30 series; CSA Z150 (Mobile Cranes); CSA Z248 (Tower Cranes); applicable provincial / territorial / federal occupational-health-and-safety regulations; your employer's safety procedures and site-specific requirements; and equipment manufacturer's specifications and operating instructions
- You hold the necessary qualifications, certifications, and training for any inspection you certify in the App
- You will treat the App as a record-keeping system, not a safety-decision system
9. Liability Waiver
To the maximum extent permitted by applicable law, SteelSight Systems, its officers, directors, employees, agents, and affiliates shall not be liable for any:
- Injuries (including death)
- Property damage
- Economic losses
- Regulatory penalties or enforcement action
- Consequential, incidental, special, or punitive damages
Arising from or related to your use of the App, reliance on any record or report stored in or generated by the App, or your failure to independently verify the equipment condition that a record purports to describe.
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and regardless of whether SteelSight Systems has been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless SteelSight Systems and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the App in connection with any inspection, maintenance, or fleet-management activity
- Your reliance on, or another user's reliance on, any record or report stored in or generated by the App
- Any injury, death, property damage, or regulatory penalty that occurs during or as a result of operations involving equipment whose records are stored in the App
- Your failure to perform required inspections or to verify equipment condition independently
- Your falsification of inspection records or audit-log entries
- Your failure to comply with applicable safety regulations, standards, or procedures
11. Acknowledgment
By using the App, you expressly acknowledge that:
- You have read and understand this Safety Disclaimer
- You accept full responsibility for the safety of any equipment you inspect, certify, or supervise
- You understand that the App is a record-keeping tool and is not a substitute for certified inspector judgment
- You understand that the App does not verify the accuracy of records you or others enter
- You waive all claims against SteelSight Systems for any damages arising from your use of the App, to the maximum extent permitted by law
12. Governing Law
This Safety Disclaimer is governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein.
