SteelSight Web Safety Disclaimer

Introduction

This Safety Disclaimer is a legally binding agreement between you and SteelSight Systems. By using the SteelSight Web application ("App"), you acknowledge and agree to the following.

SteelSight Web aggregates and displays records created by your organization's users in connected SteelSight Systems apps. This disclaimer explains the boundary between what the App does (summarize and report on entered data) and what remains your organization's responsibility (verifying records and making operational, personnel, and compliance decisions).

1. Reporting and Administration Tool Only

The App does not inspect equipment, perform safety assessments, calculate payroll of record, or determine regulatory compliance.

2. Dashboards Reflect Entered Data

Analytics, summaries, and trends displayed in the App:

• Are computed from data your organization's users entered in connected apps
• Are not verified by the App for accuracy or completeness
• Will be missing or incorrect when entries in the source apps are missing, late, or incorrect

3. Compliance and Status Indicators

Inspection compliance status, certification expiry indicators, and safety trends shown in the App:

• Are informational summaries, not regulatory determinations
• Indicate that the recorded data meets the configured criteria — not that the equipment or operation is actually safe or compliant
• Must be verified against the underlying records and original documents before operational, personnel, or compliance decisions are made

4. User Responsibility

By using the App, you acknowledge and agree that:

• You are solely responsible for operational, personnel, payroll, and compliance decisions made using information displayed in the App
• You will verify dashboard information against underlying records and original documents before relying on it
• You will ensure user roles and access within your organization are assigned appropriately
• You will comply with all applicable occupational health and safety, employment, and privacy regulations

5. Liability Waiver

To the maximum extent permitted by applicable law, SteelSight Systems, its officers, directors, employees, agents, and affiliates shall not be liable for any:

• Injuries (including death)
• Property damage
• Economic losses
• Regulatory penalties or enforcement action
• Consequential, incidental, special, or punitive damages

Arising from or related to your use of the App, reliance on any dashboard, report, or summary generated by the App, or your failure to verify the underlying records.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and regardless of whether SteelSight Systems has been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless SteelSight Systems and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the App in connection with any fleet-management, payroll-administration, or safety-administration activities
• Your reliance on, or another person's reliance on, any dashboard, report, or summary generated by the App
• Any injury, death, property damage, or regulatory penalty arising from decisions made using information displayed in the App
• Your failure to verify information against underlying records
• Your failure to comply with applicable regulations, standards, or procedures

7. Acknowledgment

By using the App, you expressly acknowledge that:

• You have read and understand this Safety Disclaimer
• You accept full responsibility for decisions made using information displayed in the App
• You understand that the App summarizes user-entered data and does not verify it
• You will not rely solely on the App for any safety-critical, payroll, or compliance decision
• You waive all claims against SteelSight Systems for any damages arising from your use of the App, to the maximum extent permitted by law

8. Governing Law

This Safety Disclaimer is governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein.
