SteelSafe Safety Disclaimer

Introduction

This Safety Disclaimer is a legally binding agreement between you and SteelSight Systems. By using the SteelSafe application ("App"), you acknowledge and agree to the following.

SteelSafe is a safety-documentation tool. It provides digital forms, templates, and storage for hazard assessments, toolbox talks, and incident reports. This disclaimer explains the boundary between what the App does (capture and store safety documentation) and what only competent people on site can do (identify hazards, implement controls, and decide whether work is safe to proceed).

1. Documentation Tool Only

The App does not identify hazards, verify that controls are in place, assess whether work is safe to proceed, or authorize work.

Completing a form in the App does not make a task safe or compliant.

2. Hazard Assessments Reflect User Input

A completed FLHA, JHA, or other safety document stored in the App reflects what the completing user entered — not verified site conditions:

• The App does not verify that listed hazards are complete or that stated controls were actually implemented
• Sign-offs record that a user signed in the App, not that the person was physically present or understood the content
• If a document is inaccurate — through honest error or deliberate falsification — the App will store and sync the inaccurate document exactly as entered

3. Templates Are Reference Only

Form templates included in the App are derived from common industry practice and regulatory guidance. These templates:

• Are starting points and must be reviewed against your employer's procedures, the specific task, and jurisdiction-specific requirements
• May not be current with the most recent revision of an applicable regulation or standard
• Do not constitute legal, engineering, or regulatory advice

4. Regulatory Recognition of Digital Records

Whether a digital safety document produced in the App satisfies a specific regulatory documentation requirement depends on your jurisdiction, the applicable regulation, and whether your employer and the applicable regulator accept digital records. Determining whether a document created in the App satisfies any particular requirement is the responsibility of you and your employer.

5. User Responsibility

By using the App, you acknowledge and agree that:

• You are solely responsible for the safety of the work you perform or supervise
• You will not treat a completed form as a substitute for actually assessing hazards, implementing controls, and exercising competent judgment
• You will comply with all applicable occupational health and safety regulations, your employer's safety procedures, and site-specific requirements
• You hold the necessary qualifications and training for any safety documentation you complete or sign

6. Liability Waiver

To the maximum extent permitted by applicable law, SteelSight Systems, its officers, directors, employees, agents, and affiliates shall not be liable for any:

• Injuries (including death)
• Property damage
• Economic losses
• Regulatory penalties or enforcement action
• Consequential, incidental, special, or punitive damages

Arising from or related to your use of the App, reliance on any safety document stored in or generated by the App, or your failure to independently identify and control hazards.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and regardless of whether SteelSight Systems has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless SteelSight Systems and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the App in connection with any construction or safety-documentation activities
• Your reliance on, or another person's reliance on, any document stored in or generated by the App
• Any injury, death, property damage, or regulatory penalty that occurs during or as a result of work documented in the App
• Your falsification of safety documentation or sign-offs
• Your failure to comply with applicable safety regulations, standards, or procedures

8. Acknowledgment

By using the App, you expressly acknowledge that:

• You have read and understand this Safety Disclaimer
• You accept full responsibility for the safety of the work you perform or supervise
• You understand that the App is a documentation tool and does not assess hazards or make work safe
• You understand that the App does not verify the accuracy of documents you or others complete
• You waive all claims against SteelSight Systems for any damages arising from your use of the App, to the maximum extent permitted by law

9. Governing Law

This Safety Disclaimer is governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein.
