SteelRoad Safety Disclaimer

Introduction

This Safety Disclaimer is a legally binding agreement between you and SteelSight Systems. By using the SteelRoad application ("App"), you acknowledge and agree to the following.

SteelRoad is a dispatch and scheduling tool. It coordinates equipment, operators, and job sites based on the data your team enters. This disclaimer explains the boundary between what the App does (organize and display scheduling data) and what remains the dispatcher's and company's responsibility (verifying qualifications, equipment suitability, and transport requirements).

1. Scheduling Tool Only

SteelRoad does not operate equipment, verify operator qualifications, assess site conditions, or authorize lifts or transport. Dispatch decisions made using the App remain the responsibility of the dispatcher and the company.

2. Certification Matching Limitations

Operator certification matching in the App:

• Compares schedules against certification records entered by users
• Does not verify that certification records are authentic, current, or applicable to the assigned equipment
• Produces missing or incorrect results when certification data is missing or incorrect

Always verify an operator's qualifications against original certification documents before assignment.

3. Conflict Detection Limitations

Conflict detection flags double-bookings within the data entered into the App. It cannot detect conflicts involving equipment, operators, or commitments that were not entered or not kept up to date.

4. Route and Travel Time Estimates

Route and travel time estimates provided by the App:

• Are approximations based on third-party map data
• Do not account for permits, escort or pilot car requirements, road bans, load restrictions, bridge clearances, or site access conditions
• Are NOT a substitute for transport planning that complies with applicable transport regulations, particularly for oversize or overweight loads

5. User Responsibility

By using the App, you acknowledge and agree that:

• You are solely responsible for dispatch and scheduling decisions, including verifying operator qualifications and equipment suitability
• You will independently verify schedules, certification records, and route plans before acting on them
• You will comply with all applicable transport, hours-of-service, and occupational health and safety regulations
• You will treat the App as a coordination tool, not a substitute for dispatcher judgment

6. Liability Waiver

To the maximum extent permitted by applicable law, SteelSight Systems, its officers, directors, employees, agents, and affiliates shall not be liable for any:

• Injuries (including death)
• Property damage
• Economic losses
• Regulatory penalties or enforcement action
• Consequential, incidental, special, or punitive damages

Arising from or related to your use of the App, reliance on any schedule, match, estimate, or record provided by the App, or your failure to independently verify dispatch information.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and regardless of whether SteelSight Systems has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless SteelSight Systems and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the App in connection with any dispatch, scheduling, or equipment-coordination operations
• Your reliance on any schedule, certification match, or estimate provided by the App
• Any injury, death, property damage, or regulatory penalty that occurs during or as a result of operations scheduled or coordinated with the App
• Your failure to verify operator qualifications or equipment suitability independently
• Your failure to comply with applicable transport and safety regulations, standards, or procedures

8. Acknowledgment

By using the App, you expressly acknowledge that:

• You have read and understand this Safety Disclaimer
• You accept full responsibility for dispatch and scheduling decisions made using the App
• You understand that the App organizes user-entered data and does not verify qualifications, equipment suitability, or transport requirements
• You will not rely solely on the App for any safety-critical decision
• You waive all claims against SteelSight Systems for any damages arising from your use of the App, to the maximum extent permitted by law

9. Governing Law

This Safety Disclaimer is governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein.
